Case Review

A Vocational Expert reviews the available medical, employment, salary/wage, and educational history; testing and assessment; opposing counsel’s opinions on labor market; lost earnings; and employability remarks.

A Case Review can often reveal weaknesses in opposing counsel’s arguments or expert testimony. It can also be used to evaluate the validity of claims of lost wages and future earning potential in claims of unfair labor practices.

Pressing Questions:

  • Does the opposing counsel have a Vocational Expert?
  • Are there unanswered questions about the client’s pre- versus post-injury work performance?
  • Does the Medical Doctor have a clear understanding of the actual job duties and environmental factors?
  • Are there enough unexplored facts in the case to justify further testing or evaluation?
